•Cable TV Services

•Home Phone Services

 

These Services are subject to availability in your area and may be modified or discontinued at our discretion. We reserve the right to update, modify, or discontinue the Services at any time.

 

 

To subscribe to and use our Services, you must:

•Be at least 18 years of age, or have a parent or guardian’s consent if you are under 18.

•Be a resident of a geographic area where the Services are offered.

•Provide accurate and complete information when subscribing to our Services.

•Maintain and update your information as necessary to ensure it remains accurate.

 

 

When you sign up for our Services, you agree to:

•Provide accurate, current, and complete information about yourself as prompted by the registration form.

•Maintain the confidentiality of your account credentials, including your username, password, and any other information used to access your account.

•Be responsible for all activities that occur under your account, including any charges incurred, regardless of whether you authorized such activities.

 

You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

 

 

•Billing and Payment: By subscribing to our Services, you agree to pay all fees and charges associated with your use of the Services. All billing cycles, rates, and charges will be outlined in the service agreement and/or on our website.

•Late Payment: If any payment is not received by the due date, we may suspend or terminate your Services until payment is made in full. You may also incur late fees or other charges as outlined in the service agreement.

•Changes to Fees: We reserve the right to modify the fees for our Services at any time. Any changes to fees will be communicated to you in advance.

 

 

You agree to use our Services in compliance with all applicable local, state, and federal laws. You may not use the Services for any unlawful or prohibited purpose, including but not limited to:

•Violating intellectual property rights, including the unauthorized sharing or distribution of copyrighted content.

•Interfering with or disrupting the operation of our network or the Services.

•Using the Services to transmit harmful or malicious content, including viruses or malware.

•Engaging in any activity that could damage or degrade the quality of our Services for other users.

 

We reserve the right to terminate or suspend your Services if we determine that you are using our Services in violation of these terms.

 

 

We aim to provide uninterrupted service; however, we do not guarantee continuous or error-free access to our Services. Our Services may be subject to occasional interruptions due to maintenance, network issues, or other unforeseen events. We will make reasonable efforts to restore service as quickly as possible but are not liable for any inconvenience, loss of data, or damage caused by service interruptions.

 

 

•Customer Equipment: You may be required to use specific equipment to access our Services (e.g., modem, router, set-top box). You may either lease the required equipment from us or provide your own, as applicable.

•Installation: We will provide installation services as part of the setup of your Services. You agree to grant access to your property for the installation of equipment and the performance of necessary services. Any damage to property caused during the installation process that is not due to our negligence will be the responsibility of the customer.

 

 

You or we may terminate your Services at any time. You may cancel your account by contacting customer support. Upon cancellation, you may be required to pay any outstanding charges, including termination fees if applicable.

 

We may suspend or terminate your Services without notice if:

•You fail to pay your bills or other charges associated with your account.

•You violate any provision of these Terms of Service.

•We are required to do so by law or due to a third-party claim.

 

 

Your privacy is important to us. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your personal data. By using our Services, you consent to the collection and use of your personal data as described in the Privacy Policy.

 

 

To the fullest extent permitted by law, NetCableLinkUp LLC is not liable for:

•Any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

•Any loss of data, service interruptions, or other issues arising from circumstances beyond our control, such as internet outages, force majeure events, or unauthorized access to your account.

 

Our liability is limited to the total amount you have paid for the Services in the 12-month period preceding the event giving rise to the claim.

 

 

You agree to indemnify, defend, and hold harmless NetCableLinkUp LLC, its affiliates, employees, agents, and licensors from any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of our Services, your violation of these Terms of Service, or any infringement of any rights of another party.

 

 

We reserve the right to modify or amend these Terms of Service at any time. Any changes will be posted on our website and will become effective immediately upon posting. You are responsible for reviewing these Terms periodically to stay informed of any changes. Your continued use of the Services after such modifications will constitute your acceptance of the updated Terms.

 

 

This Agreement will be governed by and construed in accordance with the laws of the state of Virginia, without regard to its conflict of laws principles. Any disputes arising from or related to these Terms of Service will be resolved in the state or federal courts located in Fairfax County, Virginia.

 

 

Any disputes or claims arising out of or relating to these Terms of Service shall be resolved through binding arbitration under the rules of the American Arbitration Association. You agree that any such disputes will be conducted on an individual basis and not as a class action.

 

 

•Entire Agreement: These Terms of Service, along with our Privacy Policy and any other applicable agreements, constitute the entire agreement between you and NetCableLinkUp LLC regarding the use of the Services.

•Severability: If any provision of these Terms of Service is found to be unenforceable, the remaining provisions will remain in full force and effect.

•No Waiver: The failure of NetCableLinkUp LLC to enforce any provision of these Terms does not waive its right to enforce that provision in the future.
